1. OBJECT :
The present General Conditions of Sale apply within the framework of a system of reservation and sale by distance and aim to define the modalities, between the SARL Dariguest and the Customer, of the reservation until the end of the stay, going through services and payment.
2- PRICE :
Prices are given per room per night, single or double occupancy, breakfast included plus tourist taxes (2,50 € / night / person). The prices in euro are given as an indication due to the variation of the exchange rate The rates are subject to modification.
3- RESERVATION :
The description of Riad The Diamond of Zaraba and its photos (entrance, patios, open living room, dining room, corridors, terrace, hammam, rooms) are on our website. The reservation can be made by phone, email or directly through our site.
Only those who have received written confirmation or by email of their reservation and have paid a deposit, in the name of Dariguest, have access to Riad Le Diamant de Zaraba. The booking confirmation by Riad Ayni, SARL Dariguest, implies on the part of the Customer, full acceptance of these terms and conditions which form an integral part of the accommodation contract.
When making your reservation, you must provide Riad Le Diamant Zaraba, SARL Dariguest personal information including your email address. This information will only be used for booking and occasionally to send you information about the riad.
The Customer is responsible for the validity of his email address and the contact details provided. In case of incorrect entry, Riad Le Diamant Zaraba, SARL Dariguest declines all responsibility. In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify, modify and delete data concerning you. You can exercise this right by sending an email to firstname.lastname@example.org.
4- PAYMENT :
Payment is made in Euros or dirhams, in cash (no check) or credit card (no extra charge), on arrival before taking possession of rooms, from the hostess of Riad. During the stay, any purchase in the riad: catering- drink- and any other benefit is payable at the time of the transaction.
5- CANCELLATION CONDITIONS :
a / Cancellation of the rent due to the Customer
Cancellation of the rent due to the Customer must be made by email to email@example.com.
The penalties for cancellation of the rental due to the customer, for whatever reason, are as follows:
NB: Failure to register at the place of departure or a delay in routing by air, sea, air or road, whatever the cause, or presentation of police documents, passport or other, essential to stay at Morocco, will not constitute in any case, an exemption from the expenses of cancellation and will in no way imply the responsibility of Riad Le Diamant de Zaraba, SARL Dariguest.
By cons, in case of unintentional delay, if the Client arrives at the Riad the day after the scheduled date and within the limits of the possibilities of Riad Le Diamant de Zaraba, rental dates may be reconsidered:
In any case, without any reduction compared to the initial rental price, from Riad Le Diamant de Zaraba. These negotiations in urgency will be carried out (accepted or refused), according to its possibilities, with the Hostess (or Mistress of House) and on the spot. Riad Le Diamant de Zaraba reserves the right to impose a minimum duration of stay, or the obligation to book the riad exclusively: any change in duration or number of participants on the part of the customer, which would call into question this right , constitute a cancellation on the part of the customer, without compensation or reimbursement of any kind from Riad Le Diamant de Zaraba.
b / Cancellation or modification due to Riad Le Diamant de Zaraba
The cancellation or modification of a rental due to Riad Le Diamant de Zaraba will result in the right to full refund of sums paid by the Customer in the absence of agreement, within 15 days.
NB: The cancellation by Riad Le Diamant Zaraba, SARL Dariguest does not entitle to any compensation except the full refund of sums paid.
However, and to the extent possible, if this cancellation occurs, for reasons of force majeure (degradation, fire, flood, etc.) Riad Le Diamant de Zaraba will offer the client an alternative of the same value or higher value, the latter can not refuse, in the riad, and no extra charge. Similarly, if necessary, in another riad. In the latter case, a refusal of the Customer, would result in the full refund of amounts paid that would be made under the conditions described above.
6- PROVISION OF ROOMS :
The rooms are available from 14h after completing the formalities of use, or from the arrival of Customers (before 14h), if the latter are ready.
On the day of departure, the rooms must be vacated no later than 12.00 in the morning. In the event of later departure the Customers may in the meantime, enjoy the services of the riad and their luggage may be placed in a local, without liability to Riad Le Diamant Zaraba, SARL Dariguest in case of degradation or theft.
7- RESPONSIBILITIES :
The hostess, the staff, the SARL Dariguest and the owners of Riad Le Diamant de Zaraba decline all responsibilities in case of :
In no case the responsibility of the Owners, Hostesses and Staff can not be engaged. To know that the respect of the characteristics of the architecture of a traditional riad in Morocco does not answer to the norms European or Western in general: the parapets or other guardrails of the passageways and the terrace are passable and not equipped with nets or grids protection.
Access to the kitchen and the use of utensils and appliances, ingredients or cleaning products is prohibited to anyone outside the service, even if the kitchen remains open to the dining room permanently. In case of injury, cuts, burns, poisoning or other, occurring anywhere, inside the riad and given these preventions and prohibitions, Riad Le Diamant Zaraba Ltd. Dariguest, declines any responsibility.
The most exposed people and children in particular in the Riad, are placed under the sole responsibility of their parents or legal representatives and should not be left alone without supervision, within the Riad. In case of failure or interruption, even prolonged, services of the Riad or utilities such as electricity, water, telephone, television, wifi or others, the direction of Riad Le Diamant de Zaraba will not be able to case be held responsible. In each room, a digital lock safe is at your disposal.
In case of violation or defection of the safe lock system that would result in theft of money, jewelry, credit card, camera or other valuables, the responsibility of Riad Le Diamant Zaraba, SARL Dariguest , can not be engaged in any case. Similarly for all objects in the Riad, out of the safe, which would be lost, stolen or damaged.
In any case, no incident or accident may in any case be subject to a partial or total refund of the amount of the rental, a reduction or an indemnity from Riad Le Diamant de Zaraba, SARL Dariguest. Clients are advised to be insured for illness, accidents and repatriation. The safety and supervision of children are the sole responsibility of accompanying adults. Any damage, breakage or disturbance to the stay of our other guests staying at the same time, would result either the termination of the contract of stay, or financial compensation equivalent to the various breaks or damage in case of degradation.
8- OCCUPANTS AND STAY :
No one, apart from the number of guests expected in the initial booking is allowed to enter the Riad, let alone in the rooms! Animals are not allowed in the riad and it is strictly forbidden to smoke in rooms and living rooms.
Riad Le Diamant Zaraba, SARL Dariguest would be obliged to terminate immediately and without compensation the initial reservation of any customer not respecting these clauses. Failure to comply would result in an immediate appeal to the police. Customers, Owners and Staff members are the only people with permanent access.
9- SPECIAL CASE :
A rental deposit, in case of full rental by a Client, a family or a group of friends, may be requested to cover any damage or movable property, the replacement of objects or their restoration, and possible flights. This rental deposit must be made upon arrival of the Clients, with the hostess (or Mistress of House) of Riad Le Diamant Zaraba, SARL Dariguest, in cash against receipt (check and CB not accepted). The guarantee will be returned in full at the time of departure, if no disorder was found. Otherwise, the guarantee will be cashed to cover the costs of refurbishment. Invoice duplicates will be sent to the customer as well as the eventual balance of the transaction. The amount of this deposit is 300,00 €.
10- COMMUNICATION / PHOTOGRAPHIC TAKING :
The messages intended for the Customers can be transmitted by the phone number of Riad The Diamond of Zaraba, likewise for the messages email to firstname.lastname@example.org.
The shots of the riad can only be done privately and under no circumstances be used for commercial purposes without the express written agreement of the owners of the riad.
11- POLICE FORMALITIES :
Upon arrival of each Client, the Riad The Diamond of Zaraba, SARL Dariguest is required to carry out all the formalities of use, specific to the regulations applied in Morocco.
12- TERMINATION :
Failure to comply with these general conditions of sale, which may create serious disorders, likely to harm the safety and tranquility of other Clients, may result in immediate termination, automatically and without compensation on the initial reservation. In this case, the customers concerned will have to leave Riad Le Diamant de Zaraba as soon as possible, at the order of the hostess (Mistress of the House). Depending on the severity of the disorder, a lawsuit may be filed with the Courts of Marrakech.
13- PROTEST :
Any possible complaint must be confirmed within a period of 10 days after the Client's departure, after it has been formulated in writing, during his stay with the Hostess, or by email to email@example.com. In case of disagreement, after exhausting amicable ways, only the Courts of Marrakech will be competent to settle the dispute.
14- CONCLUSION :
The purpose of these general conditions of sale is to harmonize the relationship between the Riad Management and its Clients and to create the conditions to ensure the best possible service with them. These general conditions of sale as of June 1, 2016 are applicable for all bookings, accommodations and stays from that date.
